How to find a family law or divorce attorney

January 27, 2015 by Brian Moore 36 Comments

When it is time to find a family law or divorce attorney here are a few things to consider:

Family law and divorce credentials:

The first thing to consider when you set out to find a family law or divorce attorney is whether the attorney’s practice is focused on family law and divorce or does he/she do a little bit of everything? Family law and divorce is one of the most challenging and complex areas of legal practice. Experienced family law and divorce attorneys usually only handle those types of cases plus a few additional matters that may be related such as estate planning. An attorney may handle other case types for various reasons but to practice family and divorce effectively requires that family law and divorce be the primary focus of their practice. Has the attorney received recognition from professional groups for their practice and experience as a family law and divorce attorney?

Online Reviews:

Are there positive reviews of the family law or divorce lawyer or law firm online for you to see? Are the reviews informative or just numbers based on simple criteria such as years of practice? What is stated in the reviews? Do the reviews indicate traits or skills that you are looking for? Does the lawyer or law firm have client reviews posted or available for you to view? Are the reviews positive? What attorney or law firm traits are mentioned in the reviews? Also, do the attorneys have profiles or ratings on www.Avvo.com? Are the ratings on the websites at least a “good” or better ?

Attorney or law firm website:

Have you learned about the potential attorney from his or her website? What impression did you get from the website? What attorney or law firm traits are recognizable from the website and did they appeal to you?  Does the attorney or law firm appear to share your values and seem likely to represent you in the way that you want to be represented?

Mediation training:

Does the attorney have mediation skills? Is he or she educated or involved in alternate dispute resolution? Attorneys who have been trained as mediators or collaborators have refined negotiation and mediation skills. Settlement and negotiation can save you a lot of money and emotional strain if it means no litigation. Trained mediators are often respected in the community in courts where their ability to analyze and resolve cases is appreciated.

Law Firm Technology:

Does the firm utilize modern technology for communication and case management? Is the technology available for online document sharing and collaboration? How about video conferencing and secure messaging capabilities?

Appellate Experience:

Has the attorney handled appeals to the Virginia Court of Appeals or Supreme Court involving family law or divorce issues? Appeals involve the practice of law at it s highest form. Not all attorneys handle appeals due to their complexity and difficulty. An attorney who has handled appeals in family law and divorce cases has practiced divorce and family law at its highest levels and argued legal issues before panels of the most respected judges in the state. This experience lends to their effectiveness in the trial courts.

Personality:

Taking everything into consideration, do you feel like you could work well with the attorney you are considering? Family law and divorce cases are frequently emotional and straining. Do you feel as if the attorney you are considering will be empathetic, committed, understanding, and willing to speak with you openly and honestly about your case?

I don’t get along well with a lot of people, so finding an attorney with the right personality is key. I like how you mention that after taking everything into consideration, you need to feel like you can work well with your attorney so you feel like they are being empathetic towards your case. I will have to take some time to interview the lawyers I am considering to see if our personalities match.

I love that you included sections for how to use the internet to find the right lawyer. The internet is such a great resource for finding out information about a law firm. I think in addition to the things you suggested, it’s also good to see if the lawyer has a social media profile. That way, you might be able to see the kinds of ways they communicate with clients online. That’s something I’ve suggested to my sister since she is looking for a divorce lawyer, right now.

That’s a great idea — looking online for reviews of a certain law firm. I also think it’s good to ask around to your circle of friends and family. I’ve heard that attorneys rely a lot on word of mouth to find clients, so that’s a good way to do it. My friend is trying to find a divorce lawyer; I’ll tell her your suggestions and hope it helps her out.

My wife and I got married last month and the high of it all has worn off and I think we may be separating soon within the next month. I was fascinated to know that and important question to ask yourself is have you learned about the potential attorney from his or her website. We will be sure to get a professional who can help us figure out how we can go through this process peacefully!

But since we have never been in this type of situation before, we need advice on how to find the right one to help us out. It’s good to know we will want one that is good a negotiating to hopefully save us on time and money. That is something that we will look into when we look into different law offices.

I appreciate that you mentioned to see if the attorney has skills in mediation, and it can show that they have negotiation skills. As far as I know, mediation is a great alternative that some people don’t often think about. It seems like it’s a great way to hear from both sides in a professional manner, as well as getting to a resolution that both parties can accept.

That’s a good tip to look for positive online reviews of your potential lawyer. One place you can look for those is on the BBB. The BBB lists customer reviews and ratings for the firms they catalogue.

Even after many sessions of marriage counseling, my brother and his wife just aren’t able to maintain their marriage and are considering getting a divorce. I wanted to give him some pieces of advice of my own but I would like to be thorough with what I would say. It is a good idea to check a law firm’s credentials and to check other people’s opinions about them to make sure that you are getting a quality service. You would want a lawyer who is easily reachable and would give you the time of the day to discuss the process and provide you with options to make it easier for you and your family.

It’s nice to learn that taking a divorce or family lawyer’s personality is quite important since you’ll be working with them at a vulnerable state, so knowing whether they are empathetic, professional, understanding, or committed would be quite beneficial as you’ve mentioned. I’ll be sure to look for a divorce attorney that would be able to handle my sister’s situation properly and guide her to getting custody of their children. Hopefully, I’ll be able to find one soon since I can’t take what her husband is doing to her anymore. Thanks.

It’s interesting that you mentioned how an attorney’s website can help you assess their quality as it can be a reflection of herself since everything you need to know about them should be there already. That is quite a great and convenient way for those who are suffering from divorce to locate their potential divorce attorney. Personally, if I would ever need one, I would probably go with this method too. Thanks for the helpful guide on how to find a family or law divorce attorney!

My brother needs his divorce papers prepared before the end of the year, and he needs a lawyer to help him out. That is the reason why I am glad that I came across this article and learned that one of the best ways is to check online and see if the potential lawyer has a lot of positive feedback from their previous clients. Since my brother is adamant that he only wishes to work with the best, I think this will help.

I really like how you said that it’s important, when looking for a family lawyer, to make sure that they have a focus on this specific field because it is one of the most complex areas of legal practice. My sister is struggling with her divorce and is worried about who will keep the house and the kids. I’m sure she’d really benefit from finding a family law attorney that can use their expertise and focus in the field to help with child custody and asset division. Thanks for the information.
